Terms of Use

1. Who we are

FumStop is an iPhone app published by PixelPaw SRL, a company registered in Romania. You can write to us at any time at contact@fumstop.ro — about the app, about these terms, or about your data. We answer in Romanian, and in English if you write in English.

These terms apply to the FumStop app and to this website. "We" means PixelPaw SRL; "you" means the person using the app.

2. Accepting these terms

You accept these terms when you download or use the app. If you do not agree with them, do not use it: you can uninstall it at any time, and the data saved on your phone goes with it.

You must be at least 16 to use FumStop. Below that age we cannot offer you the app, because 16 is the age at which, in Romania, you can give consent on your own for your data to be processed by an online service.

The subscription is bought through the App Store, so Apple’s own terms for that store apply to the purchase as well.

3. What the app does and does not do

FumStop counts. It shows you how many days you have been smoke-free, how much money you have kept, how much time you have gained, and what recovers in your body since your last cigarette; and in the hard moments it opens panic mode. The figures are calculated from what you enter at the start: how many cigarettes you smoked, for how long, and what your pack costs.

These are estimates, not measurements. The recovery milestones come from the published literature on the effects of quitting smoking and remain indicative — every body goes at its own pace.

FumStop is not a medical device and does not give medical advice. It does not replace a doctor, a pharmacist or an addiction specialist, it does not prescribe treatment, and it does not monitor your health. If you have a medical condition, are undergoing treatment, or are considering nicotine replacement, ask a doctor.

The app requires iOS 17 or later. We may change, add or withdraw features as the app develops; if a change materially reduces what you receive for a paid subscription, we will tell you in advance in the app.

4. Accounts and the data you enter

FumStop has no accounts. We do not ask you for an email address, a password or a profile, and we do not see what you write in the app.

What you enter — your habit, your start date, the cravings you log — stays on your phone. If you turn on sync, the data passes through your own iCloud account and reaches your other devices; that account is yours, not ours. The privacy policy describes at length what happens to it.

The figures the app shows you are accurate to the extent that what you entered is accurate. You can change the pack price or the number of cigarettes at any time in the app’s settings.

You can delete your data whenever you want, without asking us: reset from the app’s settings, or uninstall it. If you have used sync, delete the iCloud copy as well, from your phone’s settings.

5. Subscriptions, payment and renewal

The app is free to download. Its features are used on a subscription basis, and the plans and prices, in lei, are shown to you in the app before you pay anything.

The subscription is bought through the App Store, and payment is taken from your Apple account. Apple is the seller: we do not process the payment, we do not see your card details, and we do not issue your payment document.

The subscription renews automatically at the end of each period, at the price then in force, unless you cancel it at least 24 hours before the end of the current period. Your Apple account is charged within the last 24 hours of the period.

Cancellation is done in your Apple account settings, under Subscriptions — not in FumStop, because the subscription does not pass through us. After cancelling you keep access until the end of the period already paid for; after that the features that require a subscription stop, and your data stays on your phone.

If you are offered a trial period and do not cancel before it ends, it turns into a paid subscription. If we change the price, Apple notifies you before renewal and you can cancel until then.

6. Right of withdrawal and refunds

Refunds are granted by Apple, not by us: Apple took the payment, so Apple is the one who can return it. Requests are made at reportaproblem.apple.com or from your Apple account’s purchase history.

As a consumer in the European Union you generally have 14 days in which you may withdraw from a distance contract. For digital content made available immediately, that right is lost once you have expressly requested immediate access and confirmed that you thereby lose your right of withdrawal — which is exactly what happens when the subscription starts. Independently of this, Apple’s refund policy is often more generous, so it is worth asking.

If your problem is with the app rather than with the payment, write to us at contact@fumstop.ro. We will look into it and reply.

7. Intellectual property

The app, the FumStop name, the two-arc mark, the texts, the illustrations, the design and the code belong to PixelPaw SRL and are protected by law.

The subscription gives you the right to use the app on your own devices, personally and non-commercially. You may not copy, modify, decompile, rent out or resell it, and you may not use the FumStop name or mark elsewhere without our written agreement.

What you do with the app remains yours. The images it generates with your figures are yours: you can publish them wherever you like, without asking us and without paying us anything.

8. Limitation of liability

We build the app with care and we test it, but we provide it as it is, with the features it has at any given time. We do not promise that it will run without interruption and without error.

Quitting remains yours. FumStop counts, shows you and accompanies you; it does not guarantee a result and is not liable for the decisions you take on the basis of the figures in the app, still less for those concerning your health.

We are not liable for data lost from your phone — we do not hold it, so we cannot restore it to you — nor for how other people’s services work, such as the App Store or iCloud.

Nothing in this section limits our liability where the law does not permit it to be limited, and nothing in it affects the rights consumer protection legislation gives you.

9. Changes to these terms

We may update these terms when the app changes or when the law requires it. The version in force is always the one here, and the date of the last update sits at the top of the page.

If a change matters to you — what the subscription covers, for instance — we will tell you in the app before it takes effect. If you use the app after that date, it means you have accepted the new version; if you do not agree, you can cancel the subscription from your Apple account and uninstall the app.

10. Governing law and disputes

These terms are governed by Romanian law.

If you are unhappy about something, write to us first at contact@fumstop.ro: almost anything is settled there, and faster than by any other route. If we still cannot reach agreement, the dispute goes before the competent courts in Romania.

If you use the app as a consumer, you keep the protection of the mandatory rules of the country you live in, and complaints concerning payment, renewal or refunds are addressed to Apple, as the seller of the subscription.
